These Terms of Service (“Terms”) govern your access to and use of DevStand (operated by ZeroToil LLC) (“DevStand,” “we,” “us,” or “our”), including our website, marketplace, seller dashboard, and related services (the “Services”). By using the Services, you agree to these Terms.

1. The Services

DevStand is a marketplace for digital products and related tools (including Minecraft plugins and resources). We provide discovery, account, entitlement, and platform tooling. Sellers may offer products for sale; buyers may purchase access subject to these Terms and any additional seller-specific license or refund terms displayed at purchase.

2. Accounts and eligibility

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be old enough to form a binding contract in your jurisdiction, and you must comply with applicable law (including export and sanctions rules).

3. Marketplace purchases

When you buy a product, you receive a license or access rights as described at checkout and in the product listing—typically a non-exclusive, non-transferable right to use the digital product for your own projects or servers, unless the seller states otherwise. Prices, taxes, and fees shown at checkout are final for that transaction unless required otherwise by law.

Payments may be processed by third-party providers (such as Stripe). Depending on the payment method and seller configuration, funds may be charged to the seller's connected payment account with a platform fee retained by DevStand, or processed through DevStand as merchant of record for certain products or promotions.

4. Sellers

If you sell on DevStand, you represent and warrant that:

• You own or have all rights needed to list, sell, and license the content you upload
• Your listings are accurate and do not infringe intellectual property or other rights
• You will provide support and honor refund policies you publish, and comply with applicable consumer law
• You will complete any required payment-provider onboarding and keep payout details current

We may review, refuse, delist, or remove products, restrict accounts, or withhold features for trust and safety, legal, or policy reasons.

5. Acceptable use

You may not use the Services to:

• Upload malware, steal credentials, or attack systems
• Infringe copyrights, trademarks, or other rights
• Sell illegal, fraudulent, or clearly deceptive products
• Harass others, spam, or scrape the Services abusively
• Circumvent fees, entitlements, security, or moderation

6. Intellectual property and infringement reports

Sellers retain ownership of their content, subject to the licenses they grant buyers and a limited license to DevStand to host, display, promote, and deliver listings on the Services. DevStand and its licensors own the platform software, branding, and site content excluding seller materials.

If you believe content on DevStand infringes your intellectual property rights, submit a report using our Infringement report form. We may remove or restrict content and notify the relevant seller while we review.

7. Refunds and disputes

Refund eligibility depends on the product type, seller policy shown at purchase, payment-provider rules, and applicable law. Platform-sold items (for example certain ads or subscriptions) follow the terms presented at checkout. Chargebacks and payment disputes may result in suspension of buyer or seller privileges.

8. Preorders and promotions

Some products or campaigns may be offered as preorders or promotions. Delivery timing, platform delivery method, and promotional terms will be described at checkout. You are responsible for providing accurate delivery details (such as marketplace usernames) when requested.

9. Disclaimers

THE SERVICES AND MARKETPLACE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted service, that every listing is accurate, or that seller products will meet your requirements.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVSTAND AND ITS AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO DEVSTAND FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

11. Indemnity

You will defend and indemnify DevStand and its affiliates against claims, damages, and expenses arising from your content, your use of the Services, your products, or your violation of these Terms or applicable law.

12. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access, remove content, or disable payouts if we reasonably believe you violated these Terms, created risk, or as required by law or payment partners. Provisions that by nature should survive will survive termination.

13. Changes

We may update these Terms. We will post the updated Terms on this page and change the “Last updated” date. Material changes may also be communicated through the Services. Continued use after changes become effective constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Washington, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country provide otherwise. Courts in King County, Washington will have exclusive jurisdiction, subject to applicable consumer rights.
